Abstract

. In the second half of the XIX century in the Russian Empire, there was a process of reforming the judicial system, which could not but affect the Muslim population of the country, which has its own confessional legal tradition. Active interference in the life of the Muslim peoples of the Western Siberia led to the infringement of religious rights in the framework of secular legal proceedings. The restrictions imposed on the parish mullahs, as well as the lack of the ability to resolve controversial issues of the community according to Muslim law independently, that reduced their authority. The Muslim clergy were deprived of the opportunity to actively defend the religious rights of their fellow believers in the judiciary. In addition, in the second half of the 19th - early 20th centuries, there were cases of trials, in which the clergy themselves became participants. Thus, control over the activities of the Muslim clergy was established, even in the field of execution of demands. Violation of religious practice also becomes a matter of state importance and could entail bringing the mullah to justice.
