THE USE OF OFFICIAL POSITION IN THE COMMISSION OF CRIMES RELATED TO DRUG TRAFFICKING

Abstract
The use of official position significantly changes the nature and degree of public danger of criminal assault. Presence of this sign in articles of the Criminal code of the Russian Federation (further – the criminal code of the Russian Federation) providing criminal liability for illegal drug trafficking corresponds to the special importance, to the special order and conditions of the admission of persons to the considered means which are in the forbidden or limited civil turnover. The widespread use of drugs in health care and pharmaceutical activities determines the possibility of various abuses. In such a case, the use of official position implies the possibility of use and disposal of medicines. The question of the use of official position by law enforcement officers in the illegal acquisition and sale of illegal drugs is also relevant.
