Abstract

In The theory of state and law, consideration of the theoretical content of law-making stands out as aseparate, independent issue. Indeed, law-making combines aspects of government activity and the legal sphere. The state aspect is expressed in the fact that law-making is carried out by both state authorities, local governments, as well as people and other subjects, which will be considered in the main part of this scientific article. From a legal, law-making acts as an activity related to changing the sphere of legal regulation of public relations by issuing new, changing existing and repealing old laws and by-laws. In science, the signs, principles and types of law-making are formulated. At the same time, lawyers distinguish between the process of law-making and process of formation of the law. The theoretical content of law-making is considered in numerous works of Russian legal scholars. The purpose of the scientific article was to consider several positions of reputable scholars on the definition of the term «law-making», signs and characteristic features of law-making, principles and types of law-making activities. These characteristics are key to the theoretical content of law-making activities. There are also given the positions on the correlation of law-making and formation of the law.
