Аннотация

Вопросы применения нетрадиционных методов кримниалистического исследования привлекают внимание как правоприменителей-практиков, так и теоретиков криминалистики и юриспунденции, а также многих спецалистов смежных специальностей, в том числе медиков, психологов, биологов, программистов и представителей других наук. Понятие «нетрадиционных методов раскрытия преступлений» появилось в 80-90 годах ХХ века и интегрировало в себя методики и подходы прикладной психологии, психодиагностики и психофизиологии человека. Хотя мировая практика использования психологических и психофизиологических методов, подходов и технологий насчитывает более полувека, максимальную популярность данные методики и устройства, прогарммы и технологии приобретают в настоящее время. Верификация и профайлинг – два наиболее интересных и тесно связанных друг с другом современных направления психолгической криминалистики как науки психологического исследования события преступления и его участников (по «идельным» и материальным следам преступления). Они являются важными частями современной судебно-психологической экспертизы. Обе эти части реализуются в практике работы следователей / криминалистов и судей как с помощью неинструментальных (собственно экспертных), так и инструментальных (полиграф и т.п.) психологических методов и методик. Проблемами современной психологической криминалистики однако, выступают не сами по себе устройства и методики, их разработка, которая, несомненно, обогащает и криминалистику и психодиагностику в целом, но в том, что результаты исследований и практических разработок в этой сфере могут быть неправомерно расширены на другие области, в том числе в профессе гипер-секьюризации, а также в том, что не всегда достоверные и прозрачные выводы эксперта и/или оборудования, создаваемого и применяемого людьми, полагающими себя экспертами, оборудования, включая статистические методы, реализуемые цифровыми устройствами, могут быть использованы в коррумпированном сообществе, в собственных целях, против людей. Возникновение конфликта интересов тем вероятнее, чем менее обоснованы и прозрачны процедуры методики и алгоритмы верификации и профилирования, и чем более правоозхранительная система страны направлена на игнорирование потребностей сообщества в пользу интересов бюрократического монолита. И уже потом можно и нужно решать вопросы совершенствования программ и техник профилирования и верификаии: на сегодняшний день существующие подходы и устройства дают достаточно высокие показатели достоверности, но далеко не всегда.
